Privacy Notice as per Articles 13–14 of EU Regulation No. 2016/679

In its role as “data controller” as per EU Regulation No. 2016/679 (hereinafter also referred to as the “Regulation”), Ecopneus Scpa provides information regarding the processing of personal data it carries out in relation to its website, as well as its related services and functionalities, there included its newsletter. This complies with the Regulation and the Legislative Degree No. 196/03 (“Personal Data Protection Code”) and all other applicable laws.

Ecopneus is committed to respecting and protecting your privacy. It aims to ensure that you feel safe both when simply browsing its website and when you choose to provide us with your personal data. This may be, for example, to use the services made available to the Clients of Ecopneus, even by the means of the websites of Parent and/or Subsidiary Companies, to subscribe to newsletters, or to be contacted again.

The pages of our website may, however, contain links to the websites of other bodies that may not be subject to this data protection code.

Browsing data and data provided by the user

Browsing data

During the browsing of our website and in the course of their normal operation, our systems acquire certain data whose transmission is implicit in the use of web communication protocols. They may also be necessary data for the proper management and optimization of data flows, such as, for example, the pages visited.

These data may be used to obtain anonymous statistical information on the use of our website. They may also be useful to check its proper functioning, and are retained for the time strictly necessary for these purposes. The data may also be used to ascertain responsibility in the event of cybercrimes against our website.

Data voluntarily provided by the user and data used for newsletter mailing lists

Users browsing the site may send Ecopneus their personal data for accessing certain services/features or to submit requests. Examples may be: registration in sections of the website www.ecopneus.it for specific categories of operators; requests to be contacted again or to be included in newsletter mailing lists. Examples of personal data that may be provided are:  email address, personal and fiscal details, any personal data that may be inferred from communications, etc

These data shall be dealt with by Ecopneus for the sole purpose of allowing the use of the requested services/features and to manage requests, related obligations, and the activation of any contractual relationships, for the time technically necessary for these purposes. Newsletter subscriptions are retained until a request is made to unsubscribe from the mailing list.

The processing activities described here-above are necessary to comply with and respond to all requests. The provision of data is on a voluntary base. However, without it, Ecopneus will not be able to proceed with registrations, provide services, or respond to requests. Without prejudice to the rights of the data subject set out at the end of this notice, it is possible to modify or cancel newsletter subscriptions at any time, without affecting the data processing carried out up to that point.

The newsletter mailing list also includes email addresses derived from institutional and commercial/professional contacts of Ecopneus. They may also have been obtained from public directories and websites – always in line with their intended purposes. In these cases, data handling is based on the legitimate interest of Ecopneus in keeping its contractual partners and institutionally relevant stakeholders informed about initiatives and events in the sector of common interest. All communications will, in any case, be carried out in a non-intrusive manner, via email. Recipients have the right to object to their sending, without prejudice to the data processing already carried out.

When the data referred to in this section are collected for other purposes, this shall be specified from time to time in specific notices. Moreover, where necessary, consent for data processing will be requested.

Use of Cookies

Types and scope of cookies of the website of Ecopneus 

Cookies are used by websites to recognize users within a browsing session. As indicated by the provisions of the Italian Data Protection Authority, cookies are “small text files”  consisting of letters and numbers “that the websites visited by the user send to their devices (usually to the browser). Here, they are recorded and then retransmitted to the same websites upon the same user’s next visit.”

The website of Ecopneus uses cookies to enable navigation on the website and the use of its related services. For this reason, they are considered purely “technical” cookies and do not require users’ consent.

The so-called session cookies are not stored permanently on the user’s computer and disappear when the browser is closed. Their use is strictly limited to the transmission of session identifiers which consist of random numbers generated by the server. They are necessary to allow safe and efficient browsing of the website. In many cases, they also simplify navigation, as they allow users to enter their password less frequently during the same authenticated browsing session on the pages of Ecopneus. These cookies identify the IP address of the computer only anonymously. They do not store personal information such as, by way of example,  the computer name or the user’s ID. The user retains the option to accept or refuse cookies.

Moreover, some of our web pages and HTML email messages contain “pixel tags,” “web beacons,” or other technologies that are collectively referred to as: “pixel tags”. These allow us to keep track of the activities of the users who visit our website and the ones of the recipients of our email communications. We do not use pixel tags that directly collect your name, email address, or other personal data. For viewing the videos on our website pages, cookies issued by Adobe Flash Player are used; these are also anonymous and have a limited duration.

The website may also use longer-lasting or permanent cookies. For example, they may allow access to registered users’ areas without having to log in every time. They may also be used to remember actions performed by users (e.g., completing a form) when returning to a previous page within a session.

In order to understand how our visitors use our website, we use services provided by Google and Google Analytics to collect, aggregate, and analyse data in order to better understand how our website is used. These cookies have a limited duration. The information collected is used by Ecopneus in aggregated and anonymous form. For example, they may be used to monitor and analyse the use of our website, improve its functionality or select content and layout more accurately with the aim of complying with visitors’ needs.

The website of Ecopneus does not use cookies for users’ profiling.

Third parties’ cookies

The website pages of Ecopneus may contain plug-ins from the most well-known social networks (e.g., YouTube, Facebook, Twitter, Google +1) and from other services managed by involved third parties (e.g., Google Maps and the ISSUU viewer). Such plug-ins may, for example, correspond to Facebook “Like” buttons, Twitter “Retweet” buttons, or to a window requesting the playback of a YouTube video. When accessing one of our web pages equipped with such plug-ins, the Internet browser connects directly to the third-party servers, and the plug-in is displayed on the screen through the connection with the browser. The plug-in may communicate what pages the user has visited to the third-party servers. If a social network user visits our web pages while he/she is logged into their account, this information may be associated with that account. Even in the case when plug-in features are used (for example, by clicking on the “Like” button), the information will be associated with the account.

Non-acceptance and disabling of cookies 

The majorities of internet browsers are initially set to automatically accept all cookies. The user may modify these settings to block cookies or to be warned that some cookies may be transmitted to his/her device.

Several ways of managing cookies exist. The user may make reference to the instruction manual or the help screen of his/her browser to find out how to regulate or modify his/her browser settings. In case of several devices (i.e.: computer, smartphone, tablet, etc.), the user will have to make sure that every browser on every device is configurated to comply with his/her own preferences with regards to  cookies.

With regards to the cookies Analytics, Google offers a free add-on cookie for the opt-out that can be installed on all main internet browsers (v. https://tools.google.com/dlpage/gaoptout).

Technical cookies, there included the ones of Google Analytics, are necessary to facilitate the website operativity. They do not require your specific consent without prejudice to the methods indicated above. In any case, they do not do not affect the  data processing carried out up to that point. 

In case you decided to prevent the installation of cookies, this may result in the inability to provide the requested services. It may also lead to a less satisfactory browsing experience, for example due to the need of entering your login details and password more frequently.

Methods, purposes and legal bases of data processing, and data retention periods

Data processing may be also carried out with the aid of electronic or automated means. It is performed by Ecopneus and/or by third parties that Ecopneus may collaborate with to store, manage, and transmit the same data. The processing of data will be carried out using methods of organization and handling of your personal data, including data relating to logs generated upon access and use of the services made available via the web. This always in connection with the purposes indicated above and, in any case, in order to ensure the security and confidentiality of the data and all electronic communications.

All purposes, legal bases of processing, and eventual retention periods for the data have been previously indicated with reference to the individual typologies of data processed. It may be added here that data may be processed also for the defence of Ecopneus in case a legal dispute were to arise. This may happen for the legitimate interest of the same Ecopneus to protect its legal position. Furthermore, data retention may continue beyond the times indicated above only for compliance with legal obligations or for the defence of the interests of Ecopneus there included in legal proceedings. In this case, data retention will be extended for the time necessary to definitively conclude any dispute that may have risen.

Categories of recipients data may be disclosed to or who may become aware of them in their role as Data Processors or Persons in Charge 

For the pursuit of the purposes indicated above, Ecopneus may disclose and have personal data processed to third parties utilized by Ecopneus for activities related to the website and the management of services/functionalities contained therein. Examples of such services may be call-back requests and newsletters. Data treatment may be carried out both in Italy and abroad, including countries outside the European Union. Ecopneus will provide these third parties only with the information strictly necessary to perform the requested services, taking all measures to protect the personal data involved. 

Finally, data may be disclosed to public authorities upon request in the exercise of their powers. Subjects belonging to the categories listed here-above process personal data in their role as separate Data Controllers or as Processors specifically appointed by Ecopneus, in compliance with the what stated in Art. 28 of the Regulation. 

Within the scope of Ecopneus, data are made accessible exclusively to the authorised personnel that may need to have access to them due to their working activities and role within the company. Such subjects may be employees, temporary workers and/or any other “natural person” who responds directly to the authority of Ecopneus. They carry out their own working activities as they are authorised to do so and according to the instructions as per art. 30 of the Regulation of  Ecopneus.

In case of transferral outside of the European Union, the same shall be limited exclusively to those countries deemed adequate by the EU Commission. In all other cases, data transfer shall be subject to adequate assurances as per the EU Regulation  n. 679/2016, art. 46, 47 and 49, par 2, such as  “standard clauses” adopted or approved by the EU Commission, codes of conduct, and certifying mechanisms. You are allowed to ask for information with this regard, there included a copy of the data or the indication of the place where the same have been made available by making request to the contact points indicated at the bottom.

Data Subject Rights

With reference to the processing of personal data, the data subject has the right to request access to, rectification, or deletion of the same data. He/she may also ask for the limitation of the processing of their data and may also object to the same processing  without prejudice to the lawfulness of the processing carried out up to that point. He/she may also ask for data portability, within the limits and in accordance with the provisions of Articles  15-22 of the Regulation.

The data subject has also the right to lodge a complaint with the Italian Data Protection Authority. The procedures for filing a complaint are indicated on the official website of the Authority.
